Default having been made in the terms of that certain real estate mortgage made on May 27, 1994, by BOBBY DAVIS and SHENITA DAVIS husband and wife, in favor of James Harrell Hammonds, a married man, which mortgage is recorded in the Probate Office of Dallas County, Alabama, in Book 1207, at Page 340; CORRECTED as shown by separate instrument recorded in the Probate Office of Dallas County, Alabama, in Book 1208, at Page 27; TRANSFERRED to Hammonds Landmark, LLC, an Alabama Limited Liability Company, as shown by separate instrument dated January 15, 2001, recorded in the Probate Office of Dallas County, Alabama, in Book 1207, at Page 648, and said default continuing, the undersigned has elected to declare the entire indebtedness secured by said mortgage to be due and payable as provided in said mortgage, and notice is hereby given that pursuant to law, and pursuant to the terms contained in said mortgage, the undersigned will sell at public auction, to the highest bidder, for cash, in front of the main door to the Court House of Dallas County, Alabama, in Selma, Alabama, during the legal hours of sale, on August 19, 2021, the following described real estate situated in Dallas County, Alabama, to-wit:Â

Said real estate will be offered for sale in two (2) separate tracts, as shown and designated above as Parcels A and B, and also, in the alternative, said real estate will be offered or sale en masse as one combined parcel. Said real estate will be sold for the higher of the aggregate bids when offered for sale in separate tracts, as Tracts A and B, or the highest bid when offered for sale en masse as one combined parcel. PROVIDED, HOWEVER, the right is expressly reserved to reject any or all bids whether said bids are made when the property is offered for sale in separate tracts, or made when said property is offered for sale en masse as one combined parcel. PROVIDED, FURTHER, the right is expressly reserved to sell one or more but less than all of the above-described parcels (PARCELS A and B) when said lands are offered for sale in separate tracts.Â

A Mandatory Pre-Bid Meeting will be held at 10:00 AM CST, Tuesday, August 17, 2021, on site at Marion Military Institute – Board Room. All bidders must attend this meeting.Â
A cashier’s check or bid bond payable to Marion Military Institute in an amount not less than five (5) percent of the amount of the bid, but in no event more than $10,000, must accompany the bidder’s proposal. Performance and Payment Bonds and evidence of insurance required in the bid documents will be required at the signing of the Contract.Â
Drawings and specifications may be examined at the office of Morris Engineering LLC, 903 South Perry Street, Montgomery, Alabama 36104.Â
Bid documents may be obtained from the Engineer upon deposit of $50 per set, which will be refunded in full on the first set issued to each general contract bidder submitting a bonafide bid, upon return of documents in good condition within ten days of bid date. Other sets for general contractors, and sets for subcontractors and dealers, may be obtained with the same deposit, which will be refunded as above, less cost of printing, reproduction, handling, and distribution. Electronic documents are available on CD in PDF format for $25.00 each and is non-refundable.Â
Bids must be submitted on proposal forms furnished by the Engineer or copies thereof. All bidders bidding in amounts exceeding the established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Engineer; the bidder shall show such evidence clearly displaying his or her current license number on the outside of the seal envelope in which the proposal is delivered. The Owner reserves the right to reject any or all proposals and to waive technical errors if, in the Owner’s judgment, the best interests of the Owner will thereby by promoted.Â
