On Friday, Darryl Kennedy was convicted by a Dallas County jury on several charges, including murder, two counts of second-degree assault and discharging a firearm into an occupied vehicle. After deliberating for just over an hour, the jury returned a guilty verdict on all counts.

Kennedy was found guilty of the murder of Earnest Weaver Daniel III, as well as the assaults on Martavis Aaron and Marquavious Benjamin, which took place at the Raceway Gas Station on Highland Avenue in 2018.

Judge Marvin Wiggins oversaw the trial. A sentencing hearing will be scheduled at a later date. Kennedy faces a sentence ranging from 10 to 99 years or life in prison for the murder charge. He also faces a potential sentence of 1 to 10 years for the assault charges and 2 to 20 years for the charge of discharging a firearm into an occupied vehicle.

The case was prosecuted by Assistant District Attorneys Leif Hampton, Shamika Dudley and Bryan Jones.

In June 2024, a Dallas County jury found Jimmy Lee Tyus guilty of two counts of first-degree assault and shooting-into-an-occupied-vehicle in the same shooting incident.
