Vaping in public places would be prohibited under legislation that passed the Alabama Senate on Thursday.

Senate Bill 9 adds “the use of an electronic nicotine delivery system” to the law that already bans smoking cigarettes in public spaces. Violating the law carries a $25 fine.

Sponsor Sen. Gerald Allen, R-Tuscaloosa, said on the Senate floor Thursday he became aware of the need for the addition to the law after seeing people use vapes near him at sporting events, including in Bryant-Denny Stadium.

Public places outlined in the law include government buildings, restaurants, theaters, places of employment and sports and recreational facilities, among others.

The bill also changes the name of the Alabama Clean Indoor Air Act to the Vivian Davis Figures Clean Air Act, after the senator from Mobile who worked to pass the original law.

It now moves to a House chamber.
